Terms and Conditions (Public Offer) of SYNERJOY LTD
Last updated: 1 October 2026
Version dated 1 October 2026.
This document is a public offer made by SYNERJOY LTD, a private limited liability company incorporated under the laws of the Republic of Cyprus (Companies Law, Cap. 113), registration number HE478906, VAT number 60194274E, registered address: Aisopou 1-2, 3100, Limassol, Cyprus ("SYNERJOY", the "Provider", "we", "us").
The Provider offers to any natural person with full legal capacity acting for personal purposes (the "Client", "you") to enter into a services agreement on the terms set out below. These Terms have been drafted in accordance with the Cyprus Contract Law (Cap. 149), the Consumer Protection Law of 2021 (Law 112(I)/2021) and Regulation (EU) 2016/679 (GDPR). Nothing in these Terms limits any rights the Client has as a consumer under the law.
Services to companies and organisations are provided under a separate agreement.
1. Definitions
- Services — group and private classes, trial classes, programmes, workshops and events offered by SYNERJOY in the activities published on synerjoy.cy.
- Request — a request by the Client, made through the website form, by telephone or by messenger, to book the Client or the Client's child for a Service.
- Booking — a place reserved for the Client on a specific date and time and confirmed by the Provider.
- Pass — a prepaid package of classes with a limited validity period.
- Participant — the person who actually attends a class: the Client or the Client's child.
- Studio — the Provider's premises at Aisopou 1-2, 3100, Limassol, Cyprus, or any other venue stated in the Booking.
- Distance Contract — a contract concluded without the simultaneous physical presence of the parties, for example where the Client books through the website, by telephone or by messenger and pays for the Service by bank transfer or by card on the website.
2. Subject Matter and Acceptance
2.1. The Provider undertakes to provide the Services selected by the Client, and the Client undertakes to pay for them and to comply with these Terms.
2.2. A Request or a Booking on its own is not a payment and does not oblige the Client to pay for a Service.
2.3. These Terms are accepted (the offer is accepted) upon the first of the following actions by the Client:
- payment for a Service or a Pass at the Studio;
- payment for a Service or a Pass by bank transfer to the Provider's account (Section 4);
- payment for a Service or a Pass by bank card on synerjoy.cy (Section 4). At the payment step, the Client confirms acceptance of these Terms and the Privacy Policy by ticking the corresponding box in the payment form. The Provider keeps a record of the date and version of the Terms accepted by the Client;
- attendance by the Participant at a class or event under a confirmed Booking.
2.4. Upon acceptance, the agreement is concluded on the terms of the version of these Terms in force on the date of acceptance. At the Client's request, the Provider will send that version by e-mail.
2.5. If, on purchasing a Pass, the Client signs a separate agreement or rules, these supplement these Terms. In the event of any inconsistency, the term more favourable to the Client applies.
2.6. The Services are provided in person at the Studio. The Provider does not sell or deliver any goods.
3. Booking Classes
3.1. To book, the Client selects a discipline, class or event and submits a Request on the website or contacts the Provider using the details in Section 14.
3.2. In the Request, the Client provides a name and telephone number and, when booking a child, the child's name and age. The Client is responsible for the accuracy of this information.
3.3. A Booking is confirmed when the Client receives a message from the administrator or the booking system stating the date, time and place of the class. If no confirmation is received within 1 business day, the Client should contact the Provider.
3.4. When booking with payment on the website, a place is held for the Client for the time shown on the payment page. If payment is not received within that time, the hold is released automatically and the place becomes available. The Booking is confirmed once payment succeeds, and the Client receives a confirmation message. If the Booking cannot be confirmed after a successful payment (for example, because the place has already been taken), the payment is automatically refunded in full to the same card. The booking confirmation is sent to the email address entered at payment, and the receipt comes from Viva.com. If no confirmation arrives within 1 hour of payment, the Client should email the Provider at the address in Section 14, stating their name and the date and amount of the payment.
3.5. The Provider may decline a Booking if the group is full or the Participant does not meet the age or level requirements of the selected activity. The Provider will inform the Client of the reason and, where possible, offer another group.
4. Prices and Payment
4.1. Prices are published in the "Prices" section and on the discipline and event pages of the website. Prices are stated in euro and are final: they include all applicable taxes. There are no additional mandatory charges.¹
¹ VAT is charged in accordance with the laws of the Republic of Cyprus (VAT Law 95(I)/2000). Services exempt from VAT by law are provided without VAT.
4.2. Payment is made by one of the following methods:
- at the Studio in cash or by bank card before the class;
- by bank transfer using the details in Section 14. The Client states the Participant's name and the Service paid for in the payment reference. Payment is deemed made when the funds are credited to the Provider's account;
- by bank card on synerjoy.cy through the secure payment page of the payment provider Viva.com. The Client enters card details only on the Viva.com page; the Provider does not receive or store them. Payment is deemed made when the provider confirms it.
4.3. The Provider issues a receipt for every payment; for bank transfers, the receipt is sent by e-mail or messenger.
4.4. The Provider may change its prices by publishing them on the website in advance. New prices do not apply to Services or Passes already paid for.
4.5. If the Participant fails to attend without notice repeatedly (two or more times in a row), the Provider may accept the next Booking only against prepayment.
4.6. All refunds are made using the same payment method as was used for the payment. Card payments made on the website are refunded to the same card through the payment provider Viva.com. The Provider issues refunds within the time limits set out in these Terms; when the funds reach the card depends on the card-issuing bank.
5. Passes
5.1. The number of classes and the validity period of a Pass are as stated on the website or in the Studio price list on the date of purchase. The validity period starts from the date of the first class.
5.2. A class missed under a Pass is kept and may be made up within the validity period, provided the Client gave notice of the absence within the time limit in clause 7.1.
5.3. For good reason (illness of the Participant confirmed by a medical certificate, or other circumstances supported by documents), the validity of the Pass is extended by up to a maximum of 14 days.
5.4. The Client may cancel a Pass at any time. The value of the unused classes, calculated at the per-class price of the Pass, is, at the Client's choice, applied towards payment for other classes or refunded less an administrative fee of 10%. The refund is made within 14 days using the same payment method as was used for the payment.
5.5. A Pass is personal. It may be transferred to another person only with the Provider's consent.
6. Right to Withdraw from a Distance Contract
6.1. Where the agreement is a Distance Contract (Section 1), the Client may withdraw from it within 14 days of its conclusion without giving any reason (sections 20–27 of Law 112(I)/2021).
6.2. To exercise this right, the Client must send the Provider a clear statement of withdrawal to the e-mail address in Section 14 before the 14-day period expires. The Client may use the model form in Annex 1, but this is not obligatory.
6.3. The Provider will reimburse all payments received no later than 14 days from receipt of the statement, using the same payment method as was used for the payment, at no additional cost to the Client.
6.4. If the Client expressly requested that the Services begin before the end of the 14-day period (for example, by booking a class within that period), on withdrawal the Client pays for the classes actually provided before the Provider received the statement, at the per-class price of the Pass. If a Service has been fully performed at the Client's express request and the Client acknowledged that the right of withdrawal would be lost, the right of withdrawal ends.
6.5. The right of withdrawal does not apply to leisure Services provided on a specific date or within a specific period: a single or trial class, a workshop or an event on a set date. The cancellation rules in Section 7 apply to these.
7. Cancellation and Rescheduling by the Client
7.1. The Client may cancel or reschedule a Booking free of charge by giving notice no later than 12 hours before the start of the class or event.
7.2. If the Service has been paid for and is cancelled in time, the payment is, at the Client's choice, transferred to another class or refunded less an administrative fee of 10% within 14 days using the same payment method as was used for the payment.
7.3. If the Client cancels later than the time limit in clause 7.1 or the Participant fails to attend without notice, a paid single class is deemed provided and a class under a Pass is deducted. Exception: illness of the Participant or other emergency circumstances supported by documents, in which case the payment is transferred to another class.
7.4. For workshops and intensives, free cancellation is likewise available no later than 12 hours before the start. If the Client cancels later, the Client may transfer the place to another person by informing the Provider of that person's name.
8. Cancellation and Rescheduling by the Provider
8.1. The Provider may cancel or reschedule a class or event for good reason: illness of the instructor, insufficient group numbers, an emergency at the Studio or force majeure.
8.2. The Provider will notify the Client of the cancellation or rescheduling by telephone, e-mail or messenger as early as possible, and in the case of insufficient group numbers no later than 12 hours before the start, and will offer another time.
8.3. If the Service has been paid for and the new time does not suit the Client, the Provider will, at the Client's choice, transfer the payment or refund it in full within 14 days using the same payment method as was used for the payment.
8.4. The Provider may replace an instructor with another instructor of the same qualification, informing the Client accordingly. If the replacement is material to the Client (for example, for a private class), the Client may cancel the class with a full refund.
9. Children
9.1. An agreement for the benefit of a minor Participant (under 18) is concluded by the minor's parent or legal guardian. By accepting these Terms, the Client confirms that they have such authority.
9.2. The Client brings the child no later than 10 minutes before the start of the class and collects the child promptly after the class ends.
9.3. The Provider is responsible for the child during the class. Before the class starts and after it ends, the Client is responsible for the child.
9.4. If the child is to be collected by another adult, the Client informs the administrator of that adult's name and telephone number in advance. The Provider will not release a child to an unknown adult without the Client's confirmation.
10. At the Class: Rules, Health and Safety
10.1. Participants should arrive a few minutes before the start. If a Participant is late, the class is not extended and the price is not reduced.
10.2. Participants follow the instructor's directions, the Studio rules and safety requirements, take care of the Studio's property and treat other participants with respect.
10.3. Before the first class, the Client informs the Provider of any contraindications, chronic conditions, injuries and allergies of the Participant that may affect the classes. If in doubt as to whether the classes are suitable for the Participant's health, the Client consults a doctor.
10.4. A Participant showing signs of an acute infectious illness may not attend a group class. Such a class is rescheduled in accordance with clause 7.3.
10.5. The Provider may refuse to admit a Participant to a class or ask a Participant to leave in the event of a serious or repeated breach of the rules that creates a risk to the Participant or others. If the breach continues after a warning, the Provider may terminate the agreement and refund the value of the unused classes.
11. Liability
11.1. The Provider provides the Services with professional diligence: with qualified instructors, in equipped and safe premises and in accordance with the stated programme.
11.2. The Provider does not guarantee any specific result, as it depends, among other things, on regular attendance and the Participant's own effort.
11.3. The Provider is not liable for harm caused solely by the Participant's failure to follow the instructor's directions or the Studio rules, or by the Client's failure to disclose the Participant's health condition (clause 10.3). The Provider is not liable for valuables left unattended outside the storage areas, except where the Provider is at fault.
11.4. The Client compensates any damage to the Studio's property caused through the fault of the Participant.
11.5. Neither party is liable for failure to perform its obligations due to force majeure (natural disasters, decisions of public authorities, epidemics, power outages). Services paid for but not provided for these reasons are rescheduled or refunded in accordance with clause 8.3.
11.6. Nothing in these Terms limits or excludes the Provider's liability for death or personal injury caused by its fault, for wilful misconduct or gross negligence, or any rights of the Client that cannot be limited by law.
12. Personal Data, Photos and Video
12.1. The Provider is the controller of the personal data of the Client and the Participant and processes it in accordance with the GDPR, Cyprus Law 125(I)/2018 and the Privacy Policy published on synerjoy.cy. The data are used for bookings, communication with the Client, provision of the Services, accounting and compliance with legal obligations. For payments on the website, the Provider shares with the payment provider Viva.com the data needed to process the payment: the amount, a description of the Service, and the Client's name and contact details. The Client enters card details directly on the Viva.com page; the Provider does not receive or store them. Viva.com processes these data in accordance with its own privacy policy.
12.2. The Provider uses data on the Participant's health (clause 10.3) solely for the Participant's safety during classes and does not disclose them to third parties, except where emergency medical assistance is required.
12.3. Photos and video of a Participant for the website, social media and advertising are taken only with the Client's separate written consent (for a child, the consent of the parent or legal guardian). Consent may be withdrawn at any time by writing to the Provider; published materials will be removed within a reasonable time.
12.4. The Client does not take photos or video of other participants without their consent (for children, the consent of their parents).
12.5. The Client may request access to, rectification or erasure of their data and may lodge a complaint with the Cyprus Commissioner for Personal Data Protection.
13. Complaints, Governing Law and Disputes
13.1. The Client sends complaints about the quality of the Services to the e-mail address in Section 14 or hands them to the administrator at the Studio. The Provider will reply in writing within 14 days.
13.2. The agreement is governed by the laws of the Republic of Cyprus. If the Client is habitually resident in another EU Member State, the Client retains the protection of the mandatory consumer protection rules of that state.
13.3. If a dispute is not resolved, the Client may:
- file a complaint with the Cyprus Consumer Protection Service (Ministry of Energy, Commerce and Industry);
- bring proceedings before the competent court of the Republic of Cyprus (in Limassol) or before the courts of the Client's place of residence in the EU, where the law so permits.
13.4. These Terms are published in Russian and English. In the event of any discrepancy between the versions, the English version prevails.
14. Final Provisions and Company Details
14.1. The Provider may amend these Terms by publishing a new version on the website with its effective date at least 14 days in advance. A new version does not change the terms of Services and Passes already paid for. If the Client does not agree with the new version, the Client may cancel the Pass and receive a refund of the unused classes with no deduction.
14.2. The agreement remains in force until the parties have fully performed their obligations in respect of the Services paid for.
14.3. If any provision of these Terms is held invalid, the remaining provisions remain in force.
